Terms of Service

1. Eligibility and Account

You must be at least 13 years old to use the Service. If you are under 18, you must have your parent or guardian's permission to use the Service and they may need to accept these Terms on your behalf.

You are responsible for maintaining the security of your account credentials and for all activities under your account.

2. Description of Service

SayToType transforms speech into editable text using AI-powered speech recognition technology. The Service:

• Works on Windows and macOS platforms
• Voice dictation: converts live speech into text in any application
• File transcription: transcribes audio and video files you provide (e.g. meetings, interviews, lectures)
• Call and meeting recording: records and transcribes calls and meetings you take part in (see Section 5)
• Uses cloud-based AI services from third-party providers including OpenAI
• Does not store your audio, video or transcribed text on our servers

3. Your Content and Privacy

Input and Output

When you use our Service, you provide audio or video input, including live speech, files you upload and recordings you make ("Input"), and receive text output ("Output"). Input and Output are collectively "Content."

Ownership

You retain ownership of your Input and own the Output generated by our Service.

Your Responsibility for Content

You are solely responsible for your Input and for how you use the Output. By submitting Input you represent and warrant that you own it or have all rights, licenses and permissions needed to record, upload, transcribe and use it, and that doing so does not infringe any copyright, trademark, privacy, publicity or other right of any third party or violate any law. We do not review, monitor or verify Content and have no responsibility for its contents, legality or accuracy.

No Data Storage

We do not store your audio, video or transcribed text on our servers. Content is processed on receipt and discarded once the result is returned. Transcripts you keep in the app's library are stored only on your device.

Third-Party Processing

Your Input is sent to third-party AI service providers for processing. These providers process your data according to their own privacy policies and do not use your data to train their models.

4. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Record or transcribe any call, meeting or person without giving the notice and obtaining the consent required by applicable law (see Section 5)
• Upload or transcribe audio or video you do not own or have no right to use, including copyrighted material without permission
• Use the Service for any illegal, harmful, or abusive activity
• Attempt to reverse engineer, decompile, or discover the source code of our Service
• Interfere with or disrupt the Service or its servers
• Use the Service to create content that violates intellectual property rights
• Use the Service to generate harmful, defamatory, or misleading content

5. Recording Calls and Meetings

Your Responsibility

SayToType lets you record and transcribe calls and meetings. You are solely responsible for complying with all laws that apply to such recordings, including laws that require you to notify every participant and obtain their consent before recording. Many jurisdictions require the consent of all parties. You must not use SayToType to record or transcribe anyone without the notice and consent the law requires.

No Notification or Consent by SayToType

SayToType does not notify participants, does not request or obtain consent on your behalf, and does not verify that you have done so. The Service does not announce the recording to other participants.

No Legal Advice

Nothing in the Service or on our website is legal advice. It is your responsibility to determine which laws apply to you and to the participants, wherever they are located, and to seek legal advice if needed.

Your Representations

By starting a recording or transcription you represent and warrant that you have given all required notices and obtained all required consents from every participant, and that the recording is lawful.

Liability

To the maximum extent permitted by law, SayToType is not liable for any claim, penalty or damage that results from your decision to record or transcribe a call or meeting, or from your failure to give the notice or obtain the consent required by law.

6. Paid Services

Subscription Plans

Certain features of the Service require a paid subscription. We will automatically charge your payment method on each billing cycle until you cancel.

Payment

You must provide accurate billing information and authorize us to charge your chosen payment method.

Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period.

Refunds

You may request a full refund within 14 days of your initial purchase. After the 14-day period, refunds are generally not provided, except where required by law.

Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will take effect on your next billing cycle.

7. Third-Party Services

Our Service uses third-party AI providers to process your audio and generate transcriptions. These services are subject to their own terms and conditions. We are not responsible for the availability or performance of third-party services.

8. Disclaimers and Limitations

Service "As Is"

The Service is provided "as is" without warranties of any kind. We do not guarantee that transcriptions will always be accurate or error-free.

Output Accuracy

AI-generated transcriptions may contain inaccuracies. You should review and verify all Output before relying on it for important purposes.

Service Availability

We do not guarantee that the Service will be available at all times or free from interruptions.

Your Content and Recordings

We have no responsibility for the Content you record, upload or transcribe, for its lawfulness, or for the consequences of your use of the Output.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or business, arising from your use of the Service, including any claim arising from recordings or Content you make, upload or transcribe (see Sections 3 and 5).

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the six (6) months before the claim and (b) EUR 20. Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer rights.

9. Indemnification

If a third party or authority brings a claim against SayToType as a result of your actions, you agree to defend, indemnify and hold harmless SayToType, its affiliates, officers, employees and contractors from the resulting claims, damages, fines, losses and reasonable expenses (including reasonable attorneys' fees). This covers claims arising from:

• Your recording or transcription of a call, meeting or person without the notice or consent required by law
• The Content you upload, record or transcribe, including any infringement of copyright or other rights
• Your violation of these Terms or of applicable law

This does not apply to the extent a claim results from SayToType's own breach of these Terms or applicable law.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, pose a risk to us or other users, or for other legitimate business reasons.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

12. Dispute Resolution

Before filing any legal claim, please contact us at support@saytotype.ai to attempt an informal resolution. We will work with you to resolve disputes within 60 days.

If an informal resolution fails, disputes will be resolved through binding arbitration on an individual basis, not as part of a class action.

14. General

These Terms constitute the entire agreement between you and SayToType regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect.
